MARTINEZ — A former high-ranking executive with Seeno Construction is on trial facing charges that he stole more than $344,000 from the prominent East Bay development firm, by funneling settlement money to his own company.Edward Miller, 66, was Seeno Construction’s chief risk officer for nearly a decade starting in 2006. Miller’s attorney, Christopher Varnell, told jurors that the payments to Miller’s company were reimbursements from personal expenses, and that the prosecution had leaped to conclusions and not even bothered to interview his client.Seeno Jr. Is scheduled to testify as a prosecution witness during the trial, which is expected to last about a week. Jurors will be shown evidence that Miller formed his own company, Intera Risk & Insurance Services LLC, allegedly without his bosses’ permission, prosecutors say. The company listed its address at Miller’s Walnut Creek home and over several years, deposited 14 checks, totaling roughly $344,000.Miller is also charged with tax fraud for allegedly failing to disclose the money as income. The alleged scheme, Wilks told jurors, was simple: When homeowners filed “construction defect” lawsuits against Seeno, the firm would settle the suits and in turn sue subcontractors, which would in turn typically settle with Seeno. Miller would allegedly deposit a portion of those settlement checks into Intera’s coffers, using the money for gambling and other personal expenses.Varnell told a different tale, that Miller had become Seeno Jr.’s “right-hand man and confidante,” and had saved the company “tons and tons of money” over the years.
Miller was such a dedicated employee, Varnell said, that he would sometimes spend hundreds of thousands out of pocket to cover expenses, such as insurance premiums. The Intera checks were “reimbursement,” Varnell told the jury.
At some point, Varnell said, Seeno Jr.’s son, Albert Senno III, grew jealous of the close relationship between Miller and his father, and sought to squeeze Miller out of the company.“This case, to me, is about assumptions,” Varnell said, adding that Miller would take the stand in his own defense during trial. He added: “Wait until you hear all the evidence. Don’t do what the district attorney’s office did, which is leap to conclusions.”Seeno Construction has had, resulting from a 2010 federal investigation into mortgage fraud at Discovery Sales, a affiliate company. Nine people, none of them Seeno family members, pleaded guilty to various federal charges and were sentenced.
Additionally, Discovery Sales pleaded guilty to bank fraud and was fined in restitution.Seeno III was also charged in 2016, in connection with an alleged phone threat earlier that year, but the charge was eventually dropped.
